These Terms and Conditions (“Terms”) govern your use of the App and the VPN services we provide. By downloading, installing, or using the App, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please refrain from using the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

We may update these Terms at any time. Changes will be posted within the App, and significant updates will be communicated via email or in-app notifications. Your continued use of the App after such changes signifies your acceptance of the revised Terms.

The App offers virtual private network (VPN) services to enhance your online privacy and security. It is provided on an “AS IS” and “AS AVAILABLE” basis, with a free ad-supported version and an optional premium subscription version.

2.1 Free Version

  • The free version includes advertisements from third-party networks (e.g., Google AdMob) to support the service.

2.2 Premium Version

  • You may upgrade to the premium version via Apple’s In-App Subscription system, which removes ads and may provide additional features like faster servers or enhanced support.

We reserve the right to modify, suspend, or discontinue any part of the service at our discretion, with or without notice, for reasons such as maintenance, updates, or compliance with legal requirements.

3. User Accounts and Subscriptions

3.1 No Account Required

  • You do not need to create an account to use the basic VPN services. However, premium features require interaction with Apple’s subscription system.

3.2 Subscriptions

  • Management: Subscriptions are handled through Apple’s In-App Purchase system.
  • Payment: Charges are applied to your Apple ID account.
  • Renewal: Subscriptions auto-renew unless canceled at least 24 hours before the current period ends.
  • Cancellation: You can manage or cancel your subscription via your Apple account settings.

We do not store your payment details; all transactions are securely processed by Apple.

4. User Obligations

You agree to:

  • Use the App solely for lawful purposes and in accordance with these Terms.
  • Avoid actions that could harm, disable, or impair the App or its servers.
  • Refrain from attempting unauthorized access to the App, other user data, or related systems.
  • Not transmit malicious software, spam, or illegal content through the App.
  • Not reverse-engineer, decompile, or disassemble the App, except where permitted by law.
  • Respect the rights of others, including intellectual property rights, while using the App.

You are fully responsible for your actions and any consequences stemming from your use of the App.

5. Intellectual Property

To ensure the App’s integrity and security, you must not:

  • Use the App for illegal purposes, such as hacking, fraud, or distributing copyrighted material without authorization.
  • Attempt to bypass or interfere with the App’s security or encryption features.
  • Overload servers with excessive bandwidth usage or automated scripts.
  • Send unsolicited messages (spam) or engage in phishing via the App.
  • Impersonate others or misrepresent your affiliations.

We may suspend or terminate your access without notice if you violate these prohibitions.

7. Privacy and Data Collection

9. Disclaimer of Warranties

The App is offered “AS IS” and “AS AVAILABLE,” without any warranties, express or implied. We do not guarantee:

  • Uninterrupted, error-free, or virus-free service.
  • That the VPN will meet your specific needs or expectations.
  • Correction of all defects or errors.

To the fullest extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, AZTTY LLC, its affiliates, and their officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages related to your use of the App, even if we were aware of the possibility of such damages.

Our total liability for any claim under these Terms or your use of the App is limited to the amount you paid for the premium subscription in the prior twelve (12) months, if applicable. For free version users, our liability is capped at $10.

11. Indemnification

You agree to indemnify, defend, and hold harmless AZTTY LLC, its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the App.
  • Your breach of these Terms.
  • Your violation of third-party rights, such as intellectual property rights.
  • Any unlawful or prohibited activities conducted via the App.

12. Termination

We may suspend or terminate your access to the App at any time, without notice, for reasons including:

  • Violation of these Terms.
  • Service abuse (e.g., excessive bandwidth usage).
  • Legal or security requirements.

Upon termination, your right to use the App ends immediately, and any subscription fees paid are non-refundable, except where required by law. You may stop using the App by uninstalling it from your device.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, USA, excluding its conflict of law rules. Any disputes related to these Terms or your use of the App will be resolved through binding arbitration in Sheridan, Wyoming, per the American Arbitration Association’s rules. You waive any right to join a class action lawsuit or class-wide arbitration.

14. Miscellaneous

14.1 Entire Agreement

  • These Terms, along with the Privacy Policy, form the complete agreement between you and AZTTY LLC regarding the App, superseding any prior agreements.

14.2 Severability

  • If any part of these Terms is deemed invalid or unenforceable, the remaining provisions remain effective.

14.3 Waiver

  • Our failure to enforce any provision does not waive that provision.

14.4 Assignment

  • You may not assign your rights or obligations under these Terms without our written consent. We may assign ours freely.
